The BNP has announced that the Referendum Ordinance will not be presented in Parliament. As a result, the ordinance will automatically expire on April 12. According to the ruling party, since the referendum has already been conducted using this ordinance and there is no future use for it, there is no need to pass it into law. They clarified that this expiration will not render the February 12 referendum invalid.
Note of Dissent from Jamaat-e-Islami
Jamaat-e-Islami has issued a ‘Note of Dissent’ against this decision of the ruling party. Beyond the Referendum Ordinance, the government and opposition failed to reach a consensus on at least 15 out of the 133 ordinances issued by the interim government. The ruling party intends to bring changes to ordinances regarding the Human Rights Commission, appointment of judges, prevention of disappearances, and the Anti-Corruption Commission (ACC), to which Jamaat strongly objected.
Constitutional Deadlines and Committee Findings
These details emerged from a special committee meeting at the National Parliament on Sunday (March 29) night. The committee is set to submit its report to the Parliament on April 2. Under Article 93 of the Constitution, ordinances issued by the interim government were placed on the first day of the 13th Parliament’s first session. If not approved within 30 days (by April 12), they will automatically lapse. Home Minister Salahuddin Ahmed hinted that since the 12th February referendum is over, ratification is no longer necessary, comparing it to delimitation ordinances that aren’t needed for another decade.
Opposition’s Stance on Judicial Independence
Jamaat MP Rafiqul Islam Khan alleged that the BNP aims to repeal ordinances related to the Supreme Judicial Council and judicial appointments to revert to the previous system. He criticized the move as an attempt to “politicize” institutions like the Human Rights Commission and the Police Commission. Regarding the Referendum Ordinance, he questioned how the national election held on the same day could be valid if the referendum is deemed unconstitutional. The special committee’s meeting lasted three hours and was presided over by Chairman Zainul Abedin.
