Senior Supreme Court lawyer Shishir Monir has stated that the government’s stance on abolishing the enforced disappearance ordinance is legally incorrect.
Speaking at a press conference in Dhaka, he argued that the definition of enforced disappearance in the ordinance and the international tribunal is identical, making the justification for enforced disappearance ordinance removal invalid.
He cited a letter from Human Rights Commission officials, which indicated that legal provisions for investigation and penalties were clearly outlined. However, the decision to scrap the enforced disappearance ordinance ignored these aspects.
Monir warned that failure to implement an existing law and instead removing it would place responsibility on the government. He added that enforced disappearance ordinance repeal could limit justice for victims.
He also raised concerns about judicial independence and urged the government to consult legal experts before making such critical decisions.
